Foodie Pages Inc. User Agreement

Introduction

Welcome to FoodiePages.ca (the “Site”) and our online marketplace (the “Marketplace”) where we provide selling, shipping and ordering services (the “Services”).  The Site and Marketplace is owned and operated by Foodie Pages Inc., a Canadian corporation (“Foodie Pages”, “we”, “us” or “our”).

Terms and Changes to Terms

Foodie Pages provides the Services to you subject to the following terms and conditions (the “User Agreement”).  Accessing, browsing, shopping or purchasing at FoodiePages.ca indicates that you accept these terms and conditions.  Please read these terms and conditions carefully before proceeding.

Foodie Pages reserves the right to change any of the terms and conditions in the User Agreement, including all Policies and Guidelines referenced therein, at any time and in its sole discretion.  Changes to the User Agreement, including all Policies and Guidelines referenced therein, will be posted on the Site and may be done without individual notice to you.

Your continued use of the Site and Services following Foodie Pages posting of any changes to the User Agreement, including all Policies and Guidelines referenced therein, will constitute your acceptance of such changes.  If you do not agree to any changes, then you should not continue to use the Site and Services.

Foodie Pages’ Role and Services

Foodie Pages acts as a venue to allow sellers and buyers who comply with Foodie Pages policies to list, offer, sell, and buy certain food and related products and alcoholic beverages (the “products”) within a fixed price format.  Foodie Pages creates and maintains the Marketplace for registered sellers (“Producers”) to list, offer and sell products to registered users (“Users”, “you” or “your”). Foodie Pages does not make any of the products offered for sale on the Site, but from time to time may bundle individual products from various Producers into a “box” and offer the “box” for limited sale on the Site.  As a result, Foodie Pages has no control over: the quality, safety and delivery of any product listed; the truth or accuracy of the product listings; and the ability of Producers to sell products.

You agree that Foodie Pages is a venue.  As such, Foodie Pages is not responsible or liable to you, or any other party, for any: products or their descriptive content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, and links posted on the Site; deficiencies in the product you receive; issues or disputes you may have with a Producer; order cancellations; product returns; and disputes between you and Foodie Pages’ independent third party shipping provider.

Foodie Pages is not responsible for ensuring that Producers are, or remain, legally qualified to sell their products.  You use the Site and Services at your own risk.

Alcoholic Beverages

Certain producers on the Site offer products that are alcoholic beverages.  They offer these products to you for your direct importation and for your personal consumption.  Foodie Pages is not an importer of these products in the provinces that the producers deliver to, and is not their retailer, representative or agent.  These producers have special conditions in their storefront that apply to your purchase of these products, such as: (i) listing the Territories and provinces that the producer does not deliver to and will not accept orders for; (ii) the shipment of product to a delivery location is limited to a maximum of one case containing twelve (12) 750 ml. bottles (iii) the requirement for the purchaser to be of the age of majority in their province of residence to make the purchase; (iv) that purchase of products is for personal consumption only, and not for retail and resale; (v) the requirement that alcoholic beverages can only be delivered to a person 19 years of age or older, who is not intoxicated; (vi) the shipping provider will require that the receiver is 19 years of age or older by checking photo ID and obtaining a signature before handing over the goods in the order; and (vii) shipments will not be left unattended by the shipping provider.  In placing an order for these products, you accept and agree to adhere to these special conditions.

Shipping Policy

Foodie Pages uses the shipping services of Canada Post and has three different speeds of delivery.   In certain cases, less than three delivery options will be offered:  when two or more options provide the same speed, the lower cost option will be offered; and when a Producer selects to limit delivery options (for example, due to perishability of products).  Available shipping options will appear for you to choose when you check-out.  Shipment of the products you have ordered will be delivered to the delivery address you indicated in your order and according to the speed of delivery you selected when making the order.  You are solely responsible for any error in the delivery address you provide (such as the incorrect postal code for the street and city address provided) and the shipping costs resulting from such error.  You may only enter one delivery address per order.  Your credit card will be charged for the total value of the order including shipping, taxes and any special packaging costs.  These costs will appear when you check-out.

It is your responsibility to be at the delivery address to receive the shipment.  If there is no-one at the delivery address to receive the shipment, Canada Post will leave a Delivery Notice Card.  In certain cases (see Alcoholic Beverages) the shipper will require that the individual receiving the order show proof of age and a signature for receipt.  If the shipment is not picked up at the Canada Post location holding the package for pick-up within the prescribed period of time, Canada Post will return the package to the Producer and User will be responsible for the return shipping cost.  If the package is returned to the Producer, depending on the perishability of the product, you may not be entitled to a refund.  Please read the Refund and Return Policy in the policy section of the Producer’s storefront.

Damaged Shipments

All orders shipped to the User are made pursuant to a separate shipping contract between Canada Post and Foodie Pages.  Risk of loss and title to the products pass to the User when the products are delivered to Canada Post.

Should a User receive a shipment from Canada Post that appears damaged due to shipping, the User must notify Foodie Pages within 48 hours of receipt, or earlier if so stated in the policies stated in the respective Producer’s storefront, so we may submit a damage claim and coordinate any return of damaged product.  Your compensation for damaged product is limited to the refund Foodie Pages receives from the damage claim submitted to Canada Post.  Please note that the maximum value of a refund is one hundred dollars ($100) and certain contents do not qualify due to their fragile or perishable nature.  Only Foodie Pages is authorised by Canada Post to initiate a damage claim.  Users must retain the damaged product and packaging in case they are required for the damage claim assessment.  If a refund is received, Foodie Pages will either coordinate with the Producer the replacement of the damaged product at no additional cost to you, or pass on to you the refund received from Canada Post.

Shipment Tracking

All products will be shipped by Canada Post.  You can use your order tracking number in your account to access tracking information and confirm the delivery of your order.

Users are encouraged to track your orders, which are updated daily through Canada Post and provides Users with the most current information available about the location and status of your order.

Order Cancellation and Alteration Policy

Once the order is placed by the User, the User cannot cancel or alter it.

A Producer may cancel an order if it is unable to ship the entire order within the time frame specified in its Shipping Policy in the policy section of their storefront. Foodie Pages will issue a full refund for the transaction amount to the credit card charged.

Refund and Return Policy

In the event the products arrive undamaged from shipment but the contents do not match your order or they are spoiled, we will gladly refund your money for the products or replace the products if you follow the Refund and Return Policy.  In order to be eligible, you must: (i) contact Foodie Pages within the time period specified in the Producer Refund and Return Policy in the policy section of their storefront, or if such period is not posted, within two (2) days of product receipt and tell us what the issue is; and (ii) return the products to the Producer within the time period posted in their Refund and Return Policy, or if such period is not posted, within the time period requested of you in your subsequent discussions with the Producer.

If you contact Foodie Pages within the above time period, we can protect your credit card payment by withholding payment to the Producer.  If you do not contact us within the above time period, you are deemed to have fully accepted the products, waived your return and refund right and credit card chargeback right, and released Foodie Pages and Producer of any refund responsibility.

To reach us, you can e-mail Foodie Pages at orders@foodiepages.ca quoting your order number and tell us what the problem is.  Once you contact us, we will log your issue and direct the appropriate person at the Producer to contact you and resolve your issue quickly.  There may be other return and refund conditions in the Refund and Return Policy appearing in the policy section of the Producer’s storefront, such as assigning a return product authorization number before product is returned.  Please read the Producer’s Refund and Return Policy for your product carefully.

When you are required to return products, you must return them to the Producer that you bought them from.  The User must contact and notify the Producer prior to returning the products.  The User shall not return products to Foodie Pages.  Foodie Pages does not accept returned products.  Foodie Pages will send you a prepaid return shipping label to use to return the products to the Producer.

Pricing

Foodie Pages makes no warranty about the accuracy or reasonableness of prices set by Producers.

If a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, Foodie Pages has the right to cancel any orders placed for products listed at the incorrect price.  Foodie Pages will issue a full refund for the transaction amount to the credit card charged.

Coupons and Referral Program

From time to time Foodie Pages may issue coupons which can be applied to the product value in your purchase and not against shipping and handling costs, gift card, any taxes and any other transaction costs. Coupons are for one-time use, are non-refundable and may not be used on purchases with other coupons (only one coupon can be used per order), in conjunction with any other discount program or gift card offered by Foodie Pages. Any unapplied coupon value in a purchase expires and is not returned or refunded to you. In the event you purchase a Qualifying Product with a coupon and it is returned, you will receive a replacement product or be refunded for the amount that you paid in cash after applying the value of the coupon to the price of the Qualifying Product.

Coupons do not constitute an account, a payment instrument or other property owned by you. Coupons do not have a cash value, are not transferable or sellable, are not gift cards, and cannot be used to purchase gift cards.

Coupons issued to a single Foodie Pages account cannot be used for purchases on another account. Foodie Pages does not impose any fee on your use of coupons. To see your coupons check your Foodie Pages account.

Foodie Pages reserves the right to revoke your  coupons if Foodie Pages determines that you have engaged in fraudulent referral activity (such as inviting fictitious people to join Foodie Pages) or otherwise violated this Agreement or if we terminate your membership or account registration.

Foodie Pages reserves the right at any time, without notice to you to change the terms applicable to the issuance of coupons, including expiration periods, requiring minimum purchase amounts for use of coupons, instituting maximums on the amount of coupons that you may earn or coupons that you may use in one transaction, and discontinuing the coupon program entirely.  We will post an updated version of these terms in the Agreement and/or FAQ’s from time to time, and you will be deemed to have accepted such changes by continuing to use the Site after the date such changes are made.

From time to time, Foodie Pages may provide coupons to friends referred by members, and to members when their referred friends purchase Products. Participation in the referral program may require you to submit personal information about you and your friends, such as name and email address. You agree to receive communications from us as a result of your participation in the referral program, and to allow us to communicate with your friends about your participation (for example, by disclosing to your friends that an invite was sent by you). Any information collected from you or your friends as part of the referral program will be subject to our privacy policy.
